المستخلص: عقود "فيديك" هي عقود نموذجية أنشأها الاتحاد الدولي للمهندسين الاستشاريين على مدار ما يزيد عن مائة عام، وموضوع العقود: التشييد والمقاولات والبناء، وقد أخذت عقود "فيديك" موقعها المتميز عالمياً لما لها من خصائص تجعلها مقدّمة على كثير من مثيلاتها من عقود نموذجية في ذات الموضوع، وأصبحت "فيديك" معتمدة في المشاريع الدولية، والتي يكون أطرافها حكومات أو شركات كبرى في دول مختلفة، والمشاريع التي تقدّمها البنوك الدولية في إعمار الدول المتضررة من آثار الحروب والكوارث، ومن هذه الخصائص إحكام النصوص العقدية، ومرونة التعديل عليها بما لا يؤثر في إحكامها، وإحاطتها بدرجات فصل المنازعات بين أطراف العقد، وبكونها مجموعة عقود يختار منها أطراف العقد ما يلائم مشروعهم وصلاحيات كل طرف، كما أنها تتميز بأن الجهة التي أنشأت هذه العقود متخصصة في موضوع العقد بحيث يلبي العقد احتياج المتعاملين به، وتكون نتائجه وفق إرادتهم التي من أجلها أنشأوا المشروع . والبحث يقدّم تصوّراً تقريبياً للحكم الشرعي لهذه العقود، إذ سبق في كتب الفقهاء الكلام عن عقود مشابهة لعقود "فيديك" من حيث الجملة، ومن هذه العقود الفقهية عقد الاستصناع والإجارة والمقاولة، وهذا يدل على سعة أفق الفقهاء ومداركهم، وأن الفقه علم جليل يرتّب أمور الناس في معاشهم وتعاملاتهم وفق قواعد شرعية بناها الفقهاء على أدلة الشرع الذي كفل للناس السعادة في الدارين، والفلاح والهدى للناس أجمعين.

Abstract: FIDIC contracts are model contracts established by the International Federation of Consulting Engineers over more than a hundred years, FIDIC contracts have taken their distinguished position globally due to their characteristics that make them advance on many of their counterparts from model contracts in The same topic, "FIDIC" has become accredited in international projects, the parties of which are major governments or companies in different countries, and projects submitted by international banks in the reconstruction of countries affected by wars and natural disasters, and among these characteristics are the provisions of contractual texts, and the flexibility to amend them in a way that does not affect In its provisions, and it is surrounded by the degrees of disputes resolution between the contract parties, and by being a group of contracts from which the parties choose what suits their project, and it is distinguished that the party that established these contracts specializes in the subject of the contract so that the contract meets the needs of its owners. The research provides an approximation of the Islamic vision of these contracts, as in the books of jurists had previously written about contracts similar to "FIDIC" contracts, and this indicates the breadth of the horizon of Islamic scholars and their perceptions, and that Islamic law is the best way to arrange people's affairs In all their aspects of life, which guaranteed to people happiness in this life and the other life.
